Terms of the search mandate (flat search)
1. Contracting party

2. Service
Fairflat GmbH searches for housing that matches your search profile, including from landlords outside the portfolio it manages. For this purpose, and solely because of your search mandate, it obtains the landlord's or another authorised person's instruction to offer the flat to you (section 2 (1a) German Housing Brokerage Act) and provides you with the opportunity to conclude a tenancy agreement or brokers it. No specific result is owed.
3. Commission
A commission is only owed if a tenancy agreement between you and the landlord is concluded as a result of the opportunity provided or brokered by Fairflat GmbH. It amounts to 1.0 times the monthly net rent plus statutory VAT (currently 19 percent, i.e. 1.19 monthly net rents gross). Net rent is the agreed monthly rent excluding service charges that are billed separately; for a room in a shared flat, the monthly rent for the room. The commission is due when the tenancy agreement is concluded and will be invoiced.
4. No commission, no other costs
No commission is payable if the flat is managed by Fairflat GmbH, if Fairflat GmbH is its owner, tenant or landlord or is legally or economically connected with the landlord, if an existing tenancy for the same flat is merely continued, extended or renewed, if the flat is publicly subsidised or otherwise rent-controlled, or if Fairflat GmbH did not obtain the instruction to offer the flat solely because of your search mandate. No advance payments, processing, registration or writing fees or expenses are charged.
5. Term and termination
The search mandate runs for six months from conclusion of the contract and then ends automatically. You and Fairflat GmbH may terminate it at any time without notice in text form (for example by email). The commission under clause 3 remains payable for a tenancy agreement based on an opportunity provided before the mandate ended.
6. Your cooperation
Please tell us about changes to your search profile and let us know if you have found a flat elsewhere.
7. Conclusion of contract, contract text and language
By sending the form you make an offer to conclude the search mandate. Before sending, you can check and correct all entries. The contract is concluded when we accept your offer by email; this email contains the contract text with these terms and the cancellation policy. We store the contract text. The contract language is German.
8. Dispute resolution
Fairflat GmbH is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded.
To exercise your right of withdrawal, you must inform us (Fairflat GmbH, Stechbahn 8, 47533 Kleve, Germany, phone +49 2821 3981494, email info@fairflat-gruppe.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but this is not mandatory. You can also exercise your right of withdrawal online at www.fairflat-gmbh.de/widerruf/. If you use this online function, we will send you an acknowledgement of receipt on a durable medium (e.g. by email) without delay, with information on the content of the withdrawal statement and the date and time it was received.
To meet the withdrawal deadline, it is sufficient for you to send your notice of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and in any event no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will carry out the reimbursement using the same means of payment you used for the initial transaction, unless expressly agreed otherwise with you; in any event, you will not incur any fees as a result of such reimbursement.
If you requested that the services begin during the withdrawal period, you shall pay us an amount proportionate to what has been provided until you have informed us of the exercise of the right of withdrawal, in comparison with the full coverage of the contract.
Special note
Your right of withdrawal expires early if we have fully performed the service and only began performance after you gave your express consent and at the same time acknowledged that you lose your right of withdrawal once we have fully performed the contract.
